- "Services" — the legal services offered by Saksama Counsel, including mediated estate distribution, trustee support, and contested will representation.
- "Agreement" — these Terms and Conditions, together with any written engagement letter or client brief provided to you.

2. Acceptance of Terms
By using this website or engaging our services, you confirm that you have read and understood these terms and agree to be bound by them. Our services are available to individuals aged 18 and over who have the legal capacity to enter into an agreement. If you are accessing the site on behalf of a company or other entity, you confirm that you have authority to bind that entity.
3. Service Description
Saksama Counsel provides legal services in the area of inheritance and estate law. Our three core services are described on our Solutions page. Services are available to individuals and families in Sabah and across Malaysia. Availability of specific services may vary depending on the nature of the matter.
4. User Responsibilities

6. Payment Terms
Fees for legal services are confirmed in writing in the engagement letter before work begins. Published starting fees represent the minimum for each service type and may be higher depending on complexity. Invoices are due within 14 days of issue unless otherwise agreed. Fees are denominated in Malaysian Ringgit (RM). Accepted payment methods will be confirmed in the engagement letter.
If you wish to discuss the fee arrangement for your matter, please contact us before engaging services. Any agreed variation to fees will be confirmed in writing.
7. Service-Specific Terms
Mediated Estate Distribution
The outcome of mediation is not guaranteed. We do not represent either party in the process. Our role is facilitation. The written agreement, if reached, reflects the parties' own decision. We recommend each party seek independent legal advice on the resulting document if they wish.
Trustee Support
The annual trustee support engagement covers access to counsel and the services described in the engagement letter. It does not include representation in formal proceedings or preparation of court documents, which would be subject to a separate engagement.
Contested Will Representation
The written assessment provided at the start of a contested will engagement reflects our view at the time based on available information. It is not a guarantee of outcome. Legal proceedings involve inherent uncertainty and our assessment may change as new information emerges.
8. Disclaimers
The content on this website is provided for general information only and does not constitute legal advice. No solicitor-client relationship is formed by visiting this website or submitting a contact form. A formal engagement only arises when confirmed by a written engagement letter.
We do not make any representation that the outcome of a legal matter will be favourable. Results depend on many factors outside our control.
9. Limitation of Liability
To the extent permitted by Malaysian law, our liability in connection with any legal services is limited to the amount of fees paid for the specific service in question. We are not liable for indirect, consequential, or economic losses.
Nothing in these terms limits our liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.
10. Termination
Either party may terminate a legal services engagement by giving written notice. Fees for work completed up to the point of termination will remain payable. We reserve the right to terminate an engagement in accordance with our professional conduct obligations. Upon termination, we will return your papers and documents within a reasonable period, subject to any outstanding fee obligations.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from your use of this website or our services will be subject to the exclusive jurisdiction of the courts of Sabah, Malaysia. 12. Changes to These Terms
We may update these Terms from time to time. The current version is published on this page with the date of last revision. If you continue to use this website or our services after changes are published, you are taken to have accepted the revised Terms. For active client engagements, material changes will be communicated directly.
