Why Saksama Counsel

A practice built on care and clarity

Plain-Language Advice

Legal matters are explained in language suited to the person receiving it, not to impressing colleagues.

Paced to the Matter

Inheritance disputes carry emotional weight. The process moves at a rate that the family can sustain, not at the pace of billing cycles.

Written at Every Stage

Assessments, agreements, and advice notes are provided in writing so nothing depends on recollection of a verbal conversation.

Focused Practice Area

Saksama Counsel works exclusively in inheritance and estate matters, which means the knowledge brought to each file is specific rather than divided.

Sabah-Based Understanding

The practice is located in Kota Kinabalu and understands the family structures, community arrangements, and local court procedures relevant to Sabah estates.

Honest About Outcomes

Where a proposed course of action is unlikely to serve the client well, that view is given plainly — alongside a considered alternative.

Facing an inheritance matter?

Common Questions

Questions about our services

What does a mediated estate distribution actually involve? +
Mediation in an estate context means all interested family members are invited to a structured process where a trained counsel facilitates discussion. We begin with separate sessions to understand each person's position privately, then move to joint sessions when that feels ready. The goal is a written distribution agreement that everyone can accept — not necessarily one that pleases everyone entirely, but one that is workable and fair. The document produced carries the same weight as any negotiated legal agreement.
How long does the mediation process usually take? +
It varies considerably. A straightforward estate with willing parties might reach agreement in two or three sessions over a few weeks. More complex situations — multiple beneficiaries, disputed valuations, or long-standing family tension — take longer. We do not set artificial deadlines. The process continues at the pace that the family can reasonably sustain.
I have accepted a trustee appointment but feel uncertain about my duties. Can you help? +
Yes. Trustee Support and Compliance Counsel is specifically designed for individuals who find themselves in this position. Trustee duties under Malaysian law are considerable and can feel overwhelming without guidance. We offer an ongoing counsel arrangement — not a one-time meeting — so you have someone to ask whenever a decision arises that you are unsure about.
What should I expect from a contested will matter? +
We begin every contested will engagement with a written assessment: the realistic range of outcomes, the approximate costs of each path, and our honest view of the strength of the position. Some matters are stronger than they appear; others less so. That assessment is yours to keep. If you decide not to proceed with us after reading it, that is entirely your choice. If you do proceed, decisions at each stage remain with you.
Are your fees fixed or based on time? +
Our published fees represent the starting point for each engagement. The final fee for a mediation or contested matter depends on the complexity and duration of the work. We will always discuss the fee structure clearly before any engagement begins, and you will not be asked to commit to further work without knowing what it is likely to cost.
Is what I tell you confidential? +
Yes. Legal professional privilege protects your communications with us. What you share in the course of seeking legal advice is confidential. In a mediated matter, private sessions with each party are also kept separate from joint sessions unless you specifically agree otherwise.
