Estate Distribution

The situation

A family of five adult children could not agree on the distribution of a parent's estate, which included land and a business. Attempts to resolve informally had broken down twice over eighteen months.

What we did

Four mediation sessions were held over six weeks. Separate sessions were used first to understand each party's position privately. A joint session identified two areas of agreement, which formed the starting point for the written distribution document.

Outcome

All five siblings signed a distribution agreement. The matter concluded without court proceedings. Total elapsed time from first session to signing: seven weeks.

Trustee Support

The situation

An individual was appointed trustee of a modest family trust following a relative's death. He had no legal background and was uncertain about his obligations regarding distributions, record-keeping, and annual reporting.

What we did

We reviewed the trust deed and produced a plain-language written guide to his duties. We then moved to an ongoing support arrangement, conducting an annual compliance review and being available for questions throughout the year.

Outcome

Two years into the arrangement, the trustee reports that he feels confident in his role. No compliance issues have arisen. Distributions have been handled correctly each cycle.

Contested Will

The situation

A client sought to challenge the validity of a will that she believed did not reflect her father's intentions. She had been advised by another party to proceed directly to litigation.

What we did

We conducted an initial written assessment of the realistic basis for the claim, the likely cost of proceedings, and the alternative routes available. Our assessment identified a stronger route through negotiation with the other beneficiaries.

Outcome

The matter was resolved through negotiation at a fraction of the projected litigation cost. The client received a distribution she described as acceptable. Formal court proceedings were avoided.
